Privacy Policy
British Columbia’s Personal Information Protection Act (“PIPA”) sets rules for how businesses may collect, use and disclose personal information. Personal information is defined as any information that can be used to identify an individual – solely, or in combination with other information.
The Stolen Bell Distillery Ltd (“the Stolen Bell”, “we”, “us”, “our”) is committed to providing visitors, clients, and customers (collectively, “users”) with exceptional products and services. As providing these products and services necessitates the collection, use and disclosure of some personal information, we are committed to protecting users’ personal information.
What information do we collect, and how is it used?
We collect information from various sources including information that users provide via email, information we collect from users of our website, and other sources provided to us. Much of the online personal information is collected electronically by means of cookies. Personal information collected on this website include some of or all the following: name, home address, shipping address, telephone number(s), email addresses, other contact information, and any other information users may voluntarily provide.
This personal information is used to: deliver marketing materials, provide order and sales services, provide refund services, arrange shipment or delivery of goods, respond to queries and concerns, and provide any other service that may be reasonably expected or required to be undertaken for a commercial enterprise.
For the purposes of PIPA, internet protocol (IP) addresses are not considered personal information. IP addresses are automatically collected by our web servers to analyze user trends, administer our website, and to gather aggregate demographic information for analysis. Further, our website may use cookies and other technologies to provide tailored information and experiences to users during their visits. Cookies and other such technologies may be disabled but may impact the delivery of online services to any given device.
Consent
At any time a user voluntarily provides personal information to us for a specific business purpose, including completing a transaction, verifying payment information, placing an order, or arranging a shipment, delivery or return, we imply that they consent to our collecting that information and using it for that specific purpose. We will ask users directly, or provide an opportunity to opt out of collection, for personal information for marketing and promotional purposes.
Users may withdraw their consent for marketing and promotion purposes, or for the continued collection, use or disclosure of their information at any time by contacting our Privacy Officer or designated individual. Continuation and quality of services may be affected by withdrawal of consent.
We may collect, use or disclose personal information without users’ knowledge or consent in the following limited circumstances:
- When the collection, use or disclosure of personal information is permitted or required by law;
- When the personal information is available from a public source (e.g., a telephone directory);
- When we require legal advice;
- To protect ourselves from fraud; and,
- To investigate an anticipated breach of an agreement or a contravention of law.
Use and disclosure
We will only use or disclose user personal information where necessary to fulfill the purposes identified at the time of collection or for a purpose reasonably related to those purposes such as conducting user surveys to enhance the provision of our services or to contact users directly about products and services that may be of interest to them.
Third parties
We may contract or otherwise utilize the services of third parties to assist in delivering our own. This includes web services, databases, and online payment handling, as well as sales and shipping services.
Each third-party service provided on our website is governed by each respective party’s privacy policies, and in accordance with their respective jurisdictions. Links on our website may direct users away from our site. Users are no longer governed by this Privacy Policy or our Terms of Service once they leave our website. The Stolen Bell is not responsible for the privacy practices of other websites and encourages users to read their respective privacy policies.
Current and historical third-party service providers include the following:
- Shopify Inc, for the provision of an e-commerce platform allowing us to sell products and provide information to users.
Retention and security
In accordance with PIPA, we retain any personal information used to provide services, ship or deliver products, or otherwise affect an individual for one year. We will destroy documentation or other records containing personal information as soon as possible, subject to it being necessary for legal or business purposes. Certain records subject to British Columbia’s Liquor Distribution Act, and similar such legislation and policy, must be retained for a period of no less than six years.
We use a combination of administrative, physical, and technical safeguards to reduce the risk of loss, misuse, unauthorized access, disclosure and alteration of personal information including:
- Physically securing and locking filing cabinets and offices where personal information is held;
- The use of encryption, firewalls, and other digital security mechanisms; and,
- Restricting employee access to personal information as appropriate.
Changes to this policy
We reserve the right to modify this policy at any time, without notice, and with immediate effect.
Queries and complaints
Users may: request access to, correct, clarify, amend or delete their personal information we have retained, raise a question or concern, or make a privacy complaint by contacting our Privacy Officer or designated individual.
