Stolen Bell utilizes this Site to provide marketing and promotion, sales, and shipping services (jointly and individually, the “Service” or “Product”).

By visiting our Site, you engage in our Service and thus agree to be bound by the following Terms of Service, including those additional terms and conditions and policies referenced herein. Online Store Terms

You may not, in the access and use of our Site and Service, violate any laws in your jurisdiction, including but not limited to copyright laws. Age Restrictions

Users are required to be of legal age for the purchase and consumption of alcohol in their respective jurisdiction. By using this Site, users agree that they are at least the legal age to purchase and consume alcohol in their respective jurisdiction. We do not assume any legal responsibility for false statements about age.

Sale of Goods

These Terms of Service govern the sale of goods available on our Site. The following goods are, have been, or may become available on our Site:

• Packaged alcoholic beverages;
• Recurring seasonal Product offerings (“Subscription Box”, “Quarterly Subscription”);
• Apparel and other non-liquor branded Products;
• Items specifically identified with storing or serving alcoholic beverages we sell; and,
• Printed materials such as books and pamphlets.

These Terms of Service apply to all goods that are displayed on our Site at the time you access it, including any Products listed as being out of stock. All information, descriptions, or images that we provide about our goods are as accurate as possible. Supply chain and other circumstances may require alterations to Product appearance; no guarantees can be made to the accuracy of the goods we provide. You agree to purchase goods from our Site at your own risk.

Certain Services may be available exclusively through our Site. Quantities of these Services may be limited, and the return or refund of such Products may be subject to our Cancellation, Returns and Refund Policy.

We reserve the right, but are not obligated, to limit the sales of any Product or Service to any person, region, or jurisdiction. We may exercise this right on an ad hoc basis.

We reserve the right to modify, reject or cancel your order for any reason. In the event that we make a change to your order, we may attempt to notify you by contacting the email provided during order confirmation. If we cancel your order after processing your payment, a refund of the amount paid will be made. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.

Prices for listed Products are subject to change without notice. We reserve the right to modify or discontinue a Product or other Service without notice at any time.

Payments

We utilize Shopify Inc’s Shopify Payments service to process transactions on our Site. This service accepts many of the major credit cards and other payment instruments. When you provide us with your payment information, you authorize our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorize us to charge the amount due to this payment instrument, including Service costs, applicable taxes or other duties, and shipping costs. If we believe your payment has violated any law or these Terms of Service, we reserve the right to cancel or reverse your transaction.

Subscriptions

By purchasing a Subscription Box, you agree to an initial and recurring quarterly (happening on a three-month basis) subscription fee at the then-current rate plus any applicable taxes or other fees, and you accept responsibility for all recurring charges until the subscription is terminated. You may cancel your Quarterly Subscription at any time, subject to our Cancellation, Refund and Returns Policy. If a recurring charge is declined or returned, a second attempt to process the charge may be made. Service delivery will only occur upon successful payment processing.

Subscription Boxes will be shipped, subject to the Terms of Service and Shipping Policy, to the address provided at the time of initial purchase, unless you have updated the shipping address, until such time as the Quarterly Subscription is terminated.

Shipping, Pick Up and Delivery

Subject to these Terms of Service and our Shipping Policy, users may select how they receive Products they have purchased. It is your responsibility to ensure that shipping information is accurate; we assume no liability for shipping or delivering to the address provided at the time of purchase. Quarterly Subscription customers may be reminded to ensure their shipping information is up to date from time to time.

Subject to the Shipping Policy, users may be able to select how they receive their purchased Products. Eligibility for shipping, pick up, and delivery services may be determined on an ad hoc basis.

Online shipping services are handled through Shopify Inc’s Shopify Shipping service, and may be provided by any of their carriers. You may be required to pay additional shipping charges, duties, tariffs, or other fees in addition to the Product price, subject to any shipping offers. Shipping will take place as soon as reasonably possible, subject to successful payment and depending on order quantities and other factors. Delivery times may vary due to unforeseen circumstances. Please note that delivery times may not include weekends or statutory holidays.

Personal Information

The collection, use, disclosure, and retention of personal information collected through our Site is governed by our Privacy Policy.

Limitation of Liability

The Stolen Bell Distillery Ltd and its directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.
